Trackcess Terms & Conditions
Effective July 7, 2026. Applies to www.trackcess.ca and all Trackcess quotations, work orders, and service agreements. Governed by the laws of the Province of Alberta, Canada.
1. Acceptance of Terms
These Terms and Conditions ("Terms") are binding on all persons who access the website located at www.trackcess.ca (the "Website"), without qualification or exception, and on all clients who engage Trackcess Inc. ("Trackcess," "we," "us," or "our") for the sale, installation, or monitoring of security, surveillance, or access-control systems (the "Services"). By entering the Website, or by accepting a quotation, work order, or invoice from Trackcess, the user or client agrees to be bound by and is deemed to have accepted these Terms, and acknowledges having read and understood them. If you do not agree to any of these Terms, you may not enter, view, or make use of the Website, and should not accept a Trackcess quotation or work order.
2. Changes to the Website
Trackcess reserves the right to make changes to the Website, its content, and/or the services offered through it at any time and without notice.
3. User-Generated Content
Content submitted by visitors to the Website (reviews, comments, form submissions, or similar) reflects the views of those visitors and does not necessarily constitute the opinion of Trackcess, nor does it constitute legal, security, or other professional advice on any subject matter.
4. Third-Party Links
The Website may contain links to other websites. Trackcess includes these links solely as a convenience, and the presence of a link does not imply responsibility for, or endorsement of, the linked site, its operator, or its content. Trackcess has no control over third-party websites, does not review their content, and is not liable for their content or accuracy. You access third-party websites at your own risk and discretion.
5. Intellectual Property & Governing Law
The Website is owned by Trackcess, and you acknowledge that Trackcess and/or its licensors are the proprietors of all intellectual property subsisting in, pertaining to, or used on the Website, including without limitation patents, inventions, copyright, trademarks, goodwill, and trade secrets. All rights, obligations, and actions contemplated by these Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, and the courts of Calgary, Alberta have exclusive jurisdiction over any dispute arising from these Terms.
6. Permitted Use of Content
Permission is given to download and temporarily store pages of the Website for viewing on a personal or business computer. Documents made available on the Website are free for personal and business use and, for that purpose, may be edited and printed. Content on the Website is protected by copyright under international conventions; other than the permission stated above, reproduction or re-transmission of Website content is prohibited without Trackcess's prior written consent. Content may not be uploaded to community sites or forums, or published in any form.
7. Use at Your Own Risk
You use the Website at your own risk.
8. Limitation of Liability
Notwithstanding anything else in these Terms, Trackcess has no liability for any loss, damage, cost, claim, or penalty of any nature — including indirect and consequential damages and loss of profits — arising out of or in connection with these Terms or the Website, whether caused by latent or patent defects in the Website, use of the Website or information on it, or otherwise.
9. Indemnification
You indemnify Trackcess and hold it harmless against all liability, loss, damage, penalty, cost, or claim of any nature suffered by any third party in relation to any act or omission by you, your members, employees, representatives, agents, or assigns, or any third party, in relation to the Website and its use by you, and/or arising from these Terms.
10. Assumption of Risk
You assume all responsibility and risk for use of the Website. Trackcess disclaims all liability for any loss, injury, damage, cost, penalty, or claim resulting from use of the Website, direct or indirect, whether or not Trackcess has been advised of or had knowledge of the possibility of such loss.
11. Exclusion of Consequential Damages
Trackcess is not liable to you or any person or entity associated with you for compensatory, indirect, incidental, special, or consequential damages of any kind — including loss of revenue or profit, or commercial or economic loss — even if Trackcess has been advised of such damage or loss, or the damage or loss was reasonably foreseeable.
12. Products & Services Availability
All purchases through the Website are subject to product and service availability. Trackcess may, in its sole discretion, limit or cancel quantities offered on the Website, or limit sales of products or services to any person, household, geographic region, or jurisdiction.
Pricing disclaimer: Trackcess makes every effort to provide current and correct information on the Website, but errors occasionally occur. Trackcess reserves the right to refuse or cancel any order placed for items listed at an incorrect price, or in the event of any error. Prices are subject to change without notice.
13. Quotations & Estimates
Written quotations remain valid for 30 days from the date issued unless otherwise stated, after which pricing and equipment availability are subject to change. Quotations are based on the information and site conditions available to Trackcess at the time of the quote. Final pricing may be adjusted where actual site conditions (structural, electrical, network, or access) differ materially from what was represented or reasonably discoverable at the time of quoting; Trackcess will notify the client of any such adjustment before proceeding with the affected work.
14. Invoicing & Payment Terms
Unless a different arrangement is agreed in writing, the following payment terms apply to all Trackcess Services:

Invoices are deemed accepted unless disputed in writing within 10 days of receipt, specifying the item and reason in dispute. Undisputed portions of an invoice remain due on the original terms.
15. Late Payment & Interest
Accounts not paid within the applicable term are overdue. Trackcess may charge interest on overdue balances at 1.5% per month (19.56% per annum), or the maximum rate permitted by law, whichever is lower, calculated from the due date until paid in full. The client is responsible for all reasonable costs of collection, including legal fees, incurred by Trackcess in recovering an overdue account.
16. Suspension for Non-Payment
Trackcess may suspend monitoring, service, support, or warranty coverage on any account with a balance overdue by more than 15 days, without further notice, until the account is brought current. Trackcess is not liable for any loss arising from a suspension of service under this section.
17. Title, Retention & Security Interest
Title to any equipment supplied by Trackcess does not pass to the client until Trackcess has received payment in full for that equipment. Until then, Trackcess retains a security interest in the equipment supplied and may register that interest under the Personal Property Security Act (Alberta). Trackcess may also be entitled to register and enforce a lien against the client's property under the Prompt Payment and Construction Lien Act (Alberta) for unpaid amounts relating to installation work. If an account remains unpaid after the notice and suspension steps above, Trackcess may recover installed equipment to the extent permitted by law.
18. Change Orders
Any change to the agreed scope of work — requested by the client or required due to site conditions — must be confirmed in writing before Trackcess proceeds, and may result in an adjustment to price, materials, and schedule. Verbal instructions to proceed with a change are confirmed by Trackcess in writing as soon as practicable and are billed on the same terms as the original work.
19. Warranty
Trackcess warrants its installation workmanship for 12 months from the date of substantial completion. Equipment is covered by the applicable manufacturer's warranty, which Trackcess will pass through to the client; Trackcess does not extend its own warranty on hardware beyond the manufacturer's terms. This warranty does not cover damage or failure caused by misuse, power surges or outages, unauthorized modification, third-party service work, network changes outside Trackcess's control, or acts described in Section 22 (Force Majeure).
20. Security System Disclaimer
Security, surveillance, and access-control systems installed or monitored by Trackcess reduce risk but cannot guarantee the prevention of theft, break-in, injury, loss, or damage. Trackcess is not an insurer, and these Terms are not a substitute for the client's own property, liability, or business insurance. Trackcess is not liable for any loss or damage arising from a system's failure to prevent or detect an incident, including failures caused by power outages, network or internet outages, monitoring-provider or third-party carrier failure, or client failure to maintain, test, or properly use the system as instructed.
21. Cancellation & Restocking
A client may cancel a project prior to the start of work; deposits are refundable less any costs Trackcess has already incurred on the client's behalf, including equipment ordered specifically for the project. Custom or special-order equipment is non-cancellable and non-refundable once ordered. Standard stock equipment returned unused and in resalable condition within 30 days is subject to a 15% restocking fee.
22. Force Majeure
Trackcess is not liable for any delay or failure to perform caused by events beyond its reasonable control, including severe weather, labour disruption, supply-chain or manufacturer delay, utility or network outage, or government order. Affected timelines are extended by a period equal to the delay.
23. Confidentiality
Site plans, access credentials, camera layouts, network configurations, and similar project information exchanged between Trackcess and the client are treated as confidential and used only for the purpose of delivering and supporting the Services.
24. General Provisions
These Terms, together with any signed quotation or work order, form the entire agreement between the client and Trackcess regarding the Services, and supersede prior discussions or proposals on the same subject. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Trackcess may update these Terms at any time by posting a revised version on the Website; continued use of the Website or engagement of Services after posting constitutes acceptance of the update.
